Please read these Terms and Conditions ("Terms") carefully before using the Reskot software-as-a-service platform (the "Service") operated by Pragati Path Solutions ("us", "we", or "our"). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
1. Service Provision and Availability
The Service is provided on an "as-is" and "as-available" basis. We do not warrant that the service will be uninterrupted, error-free, or 100% secure. We disclaim all liability for any interruptions, bugs, maintenance, or failures of third-party services (like cloud infrastructure or payment gateways) that may affect the Service.
2. User Accounts and Responsibilities
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You are solely responsible for all data entered and activities conducted through your account, including by your staff or other end-users. You must ensure that your use of the Service complies with all applicable laws and regulations.
3. Acceptable Use
You agree not to misuse the Service. For example, you must not use the Service for any illegal activities, including but not limited to creating fake bills, tax evasion, or storing illicit data. The responsibility for any such misuse lies solely with you, the user.
4. Subscription, Payments, and Refunds
The Service is billed on a subscription basis. All fees are exclusive of applicable taxes. We use third-party payment gateways to process payments. Our refund policy is detailed in our Refund Policy, which is an integral part of these Terms.
5. Suspension and Termination
We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms, payment failure, or suspected illegal activity.
6. Intellectual Property and Data Ownership
You (the restaurant owner) retain all ownership rights to the data you submit to the Service ("Your Data"). However, the Service and its original content, features, functionality (including all software, code, logic, UI, and analytics methodologies) are and will remain the exclusive intellectual property of Pragati Path Solutions. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
7. Multi-Tenant Architecture
The Service operates on a multi-tenant architecture where your data is logically separated from that of other tenants. While we take extensive measures to ensure data isolation, we do not claim an absolute "zero breach guarantee."
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Pragati Path Solutions, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. Our maximum aggregate liability under these terms shall be limited to the amount you have paid to us in the three (3) months immediately preceding the event giving rise to the claim.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes will be subject to the exclusive jurisdiction of the courts located in our operating city.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any changes. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
